Terms of Service

Welcome to Clean Earth Waterscapes. These Terms of Service (“Terms”) apply to your use of the Clean Earth Waterscapes website and provide general terms for requesting and receiving services from Clean Earth Waterscapes (“Clean Earth Waterscapes,” “we,” “us,” or “our”).

Our services include pond and waterscape design and construction, water features, pond maintenance, and related services throughout Middle Tennessee.

Estimates and Proposals

Estimates and proposals are based on the information and site conditions reasonably available to us at the time they are prepared.

Unless otherwise stated, estimates are valid for 30 days. An estimate is not a guarantee of future pricing, availability, or scheduling.

A separate written proposal, agreement, or contract may establish the specific scope of work, pricing, payment terms, schedule, warranties, and other requirements for a project.

When a customer signs or otherwise enters into a separate written contract or agreement with Clean Earth Waterscapes, that agreement governs the project. If these Terms conflict with a signed customer agreement, the signed agreement controls.

Scheduling and Service

We make reasonable efforts to meet scheduled service and project dates. Schedules may change due to weather, material availability, site conditions, supplier delays, prior project schedules, emergencies, or circumstances outside our reasonable control.

Customers are responsible for providing reasonable access to the property as needed for Clean Earth Waterscapes to perform the agreed-upon services.

Pricing and Payment

Payment terms vary depending on the service or project and will be provided in the applicable estimate, proposal, invoice, or contract.

We accept:

  • Check
  • Credit card
  • ACH

Customers are responsible for payment according to the terms stated on their applicable invoice, proposal, or contract.

Any applicable late fees, finance charges, collection costs, or other payment requirements are governed by the applicable customer agreement or invoice.

Changes to Project Scope

Conditions discovered after work begins may require changes to the originally anticipated scope of work.

If previously unknown site conditions or customer-requested changes materially affect the scope, cost, or schedule of a project, Clean Earth Waterscapes will communicate those changes with the customer and obtain any required approval before proceeding with additional work, subject to the applicable contract.

Workmanship and Component Warranties

Clean Earth Waterscapes provides a 12-month warranty on workmanship, subject to the terms and limitations of the applicable project agreement.

Individual products and components may be covered by manufacturer warranties rather than by Clean Earth Waterscapes directly.

Component warranties may depend on applicable manufacturer requirements, proper installation and operation, routine maintenance, water quality, electrical conditions, and other requirements.

Specific warranty terms contained in a customer’s written proposal or contract control over these general Terms.

Customer Responsibilities

Customers are responsible for providing accurate information about their property and requested services and for notifying Clean Earth Waterscapes of known conditions that may affect the work.

Customers are also responsible for providing reasonable property access and complying with any preparation, approval, or other requirements communicated in connection with their project or service.

Text Messaging

Clean Earth Waterscapes may use text messaging to communicate with customers regarding requested services and customer accounts.

Our messaging program may include:

  • Appointment confirmations and reminders
  • Scheduling communications
  • Estimated arrival times
  • Project and service updates
  • Customer support
  • Invoice, payment, and account-related communications

Message frequency varies. Message and data rates may apply.

To opt out of text messages, reply STOP at any time. After opting out, you may receive one confirmation message, and no further messages will be sent unless you subsequently provide consent.

Consent to receive text messages is not required to purchase services from Clean Earth Waterscapes.

Project-specific pricing, scope, scheduling, warranties, and other terms are established by the applicable estimate, proposal, invoice, or signed agreement.

To the extent permitted by applicable law, Clean Earth Waterscapes is not responsible for losses resulting solely from reliance on general website information rather than a current estimate, proposal, invoice, or written agreement.

Nothing in these Terms is intended to waive or limit any right or obligation that cannot legally be waived or limited.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our business, services, technology, or legal requirements. Updated Terms will be posted on this page with a revised effective date.
